Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the Nokku mobile application (the "App") operated by Nokku (“we,” “us,” “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you accept and agree to be bound by these Terms, including any additional terms and policies incorporated by reference. We reserve the right to modify, update, or change these Terms at any time, and such changes will take effect immediately upon posting on the App. It is your responsibility to review the Terms periodically.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old, or that you have the legal authority to enter into these Terms.

3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

4. License Grant

We grant you a limited, non-exclusive, non-transferable license to download, install, and use the App on your mobile device solely for personal, non-commercial purposes in accordance with these Terms. You may not reverse engineer, decompile, or attempt to extract the source code of the App, except where expressly permitted by law.

5. User Conduct

You agree not to:

• Violate any applicable law or regulation;

• Engage in any activity that may harm, disrupt, or interfere with the App’s operation or other users’ experience;

• Use the App for any unlawful, harmful, fraudulent, or malicious purposes;

• Attempt to access or modify data that you are not authorized to access;

• Infringe upon any intellectual property rights of third parties.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at https://www.nokku.app/privacy-policy. By using the App, you consent to the collection, use, and disclosure of your personal data as outlined in the Privacy Policy.

7. Third-Party Links and Content

The App may contain links to third-party websites or resources. We are not responsible for the availability, accuracy, or content of these third-party sites or resources, and you access them at your own risk.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time and without notice, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease, and you must uninstall the App from your device.

9. Disclaimers

The App is provided "as is" and "as available," without any warranties, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be error-free or uninterrupted, or that it will meet your specific requirements.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data arising from your use of or inability to use the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nokku, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of third parties.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Utah, USA, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved exclusively in the courts located in Utah.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, along with our Privacy Policy and any other legal notices published on the App, constitute the entire agreement between you and us concerning your use of the App.
